These E-Commerce Rules (hereinafter referred to as the "Rules") are a mandatory and integral part of the contract of sale and purchase concluded between the online store https://kiviboutique.com (hereinafter referred to as the "E-Commerce Store") and a person - the customer (hereinafter referred to as the "Customer"), which introduces the Customer with the terms and conditions of purchase and sale of goods of the E-Commerce Store and establishes the rights and obligations of the E-Commerce Store and the Customer in relation to the purchase and sale of goods at the Online Store.
I. GENERAL PROVISIONS
1. The following are entitled to use the E-shop services:
1.1. able-bodied natural persons aged at least 18 years;
1.2. minors between the ages of 16 and 18 only with the consent of their parents, adoptive parents or guardians, except in the case of self-disposal of their earnings or scholarship;
1.3. legal persons;
1.4. authorised representatives of all the above.
2. If the Customer wishes to use the services of the Online Shop and place an order, he/she must register. The registration shall be deemed to be completed and valid when the Customer electronically submits his/her personal information and proceeds to the next steps.
3. The personal data (name, surname, address, telephone number, e-mail address) provided by the Customer when registering in the E-shop shall be stored and processed in accordance with the Law of the Republic of Lithuania on the Legal Protection of Personal Data of June 11, 1996 (current version) and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC ("General Data Protection Regulation"), and with the Privacy Policy described in this e-shop https://kiviboutique.com.
4. The prices of the goods listed in the E-shop catalogue are valid only for the purchase of these goods in the E-shop. The prices of the goods in the E-shop are inclusive of all taxes applicable in accordance with the Law on Tax Administration of the Republic of Lithuania and other legal acts. Delivery prices are not included and are to be quoted separately when placing an order. The delivery price shall be clearly indicated to the Customer prior to order confirmation and shall be highlighted in the order confirmation itself.
5. The contract of sale and purchase between the Customer and the E-shop shall be deemed to have been concluded from the moment when the Customer has created a shopping cart, indicated the delivery address, selected the payment method and has read (after reading, notes that "I have read and agree to the terms and conditions of the page") these Terms and Conditions and clicked on the button "Checkout". The contract concluded electronically between the E-shop and the Customer shall be governed by the Civil Code of the Republic of Lithuania.
6. The E-shop shall inform the Customer about the conclusion of the contract of sale by sending a notification to the email address indicated by the Customer.
II. CLIENT RIGHTS AND OBLIGATIONS
7. The Customer may select and order any product(s) from the catalogues of the E-shop.
8. By using the services of the E-shop, the Customer agrees to these Terms and Conditions of the Purchase and Sale Agreement and must comply with them.
9. The Customer must provide complete and correct data in the E-Shop registration form. If the Customer's personal data is changed and the E-Shop is not informed, the Customer assumes all risk of loss arising therefrom.
10. The Customer is responsible for all of his/her actions in using the Online Shop.
11. It is forbidden for the same person to register and use the services provided by the Online Shop under more than one name.
12. The Customer must be present at the place and time specified and accept the goods ordered.
13. The Customer undertakes not to disclose his/her registration and login data to any third party. If the Customer loses his/her login data, he/she must immediately inform the E-shop by e-mail to info@kiviboutique.com or in writing to Kosmonautų g. 12-5, Marijampolė, or by phone +370 643 21464. The e-shop shall not be liable for the actions of third parties who have used the Customer's login data prior to the moment of notification. In such case, the E-shop shall be entitled to assume that the Customer has performed the actions in the E-shop.
14. The E-shop shall not be liable for the actions of third parties when they use the Customer's banking system to enter into purchase and sale agreements using the E-shop services.
15. In order to be able to offer the Customer the full range of services on our website, we ask for your permission to store information (cookies) on your computer (device). The information recorded will be used to identify the Customer as a previous user of the website and to collect website traffic statistics. The Customer can view the information (cookies) we record at any time and can delete some or all of the cookies we have recorded. The Customer also has the right to object to the recording and use of information (cookies) on the Customer's computer/device, but in this case, some features of the website may not be available to the Customer. You can withdraw your consent at any time by changing your browser settings or by contacting the E-shop at any of the contact details published on the website.
III. EL. RIGHTS AND OBLIGATIONS OF THE SHOP
16. If false, inaccurate, misleading or incomplete data are provided during registration or subsequently, or if the Customer fails to comply with other obligations provided for in these Terms and Conditions, the E-shop shall have the right to immediately cancel the registration and delete the Customer's data, or to limit the Customer's right to use the services provided by the E-shop. The Customer shall be solely responsible for the consequences of any incorrect data provided by the Customer.
17. The e-shop reserves the right to:
17.1 Suspend or terminate the Customer's registration and use of the E-Shop without prior notice if there is reason to believe that the Customer is engaging in any unauthorised activity or otherwise attempting to interfere with the E-Shop's operation or stable functioning;
17.2 In the event of serious circumstances, temporarily or permanently discontinue the operation of the Online Shop without prior notice to the Customer.
18. The E-shop undertakes to provide all the conditions for the Customer to use the services provided by the E-shop.
19. In the event of unforeseen circumstances, if the e-shop is unable to deliver the ordered goods to the Customer, the e-shop undertakes to offer the Customer an analogous product. If the Customer refuses to accept the analogue product, the money paid shall be refunded within 3 (three) working days, provided that the Customer has made a prepayment.
IV. PAYMENT FOR GOODS
20. The Customer may pay for the Goods by:
20.1. using the Bank's online banking systems;
20.2. credit and debit cards;
20.3. by advance bank transfer;
20.4. in cash in our shops.
V. DELIVERY OF GOODS
21. The e-shop undertakes to deliver the goods ordered by the Customer after payment to the address specified in the Customer's order in the territory of Lithuania and other EU countries:
21.1.In case of payment in accordance with Clauses 20.1, 20.2, 20.3 of the Terms and Conditions, the Goods shall be delivered in Lithuania within 1-3 (one - three) working days from the receipt of confirmation from the bank. In other EU countries, the goods shall be delivered within 5-14 (five - fourteen) working days after confirmation from the bank.
22. The goods will be delivered by an authorised representative of the e-shop. Once the Customer has signed the consignment note or collected it from the post offices of the authorised representatives, the consignment shall be deemed to have been duly handed over (delivered).
23. At the time of delivery of the Goods, the Customer must inspect the condition of the consignment together with an authorised representative of the Online Shop. If the Customer notices any damage to the consignment, the Customer must note it on the consignment note and draw up a free-form consignment damage report. Once the Customer has signed the consignment note without any comments, the consignment shall be deemed to have been handed over in good order. If the delivered goods do not contain any parts or documents, the Customer must immediately inform the administration of the E-shop by e-mail info@kiviboutique.com or in writing to the addressKosmonautų g. 12-5, Marijampolė, or by phone +370 643 21464 or to the telephone numbers indicated in the section "Contacts".
24. Delivery costs are not included in the price quoted in the E-shop and are quoted as set out in Clause 4 of the Terms and Conditions.
VI. RETURN OF GOODS
25. After more than 14 (fourteen) days from the date of delivery of the goods, the Rules of Retail Trade of the Republic of Lithuania shall apply to the return of goods.
26. When returning a faulty product, the E-shop undertakes to accept the faulty product and, in the absence of any objection by the Customer, to replace it with an analogous product. If the Customer objects to the replacement of the faulty product with a quality product, the money paid for the faulty product will be refunded within 3 (three) working days from the date of return. In the event that the E-shop proves to be unavailable, the Customer will be refunded the money paid for the product within 3 (three) working days from the moment of this discovery.
27. The returned product must be fully complete. The customer is responsible for the complete assembly of the goods. If the goods are not complete, they are not accepted for return.
28. In cases where you notify your withdrawal from the contract of sale within 14 (fourteen) days of delivery of the goods (page 26 of the Rules), you must submit a completed withdrawal form (free-form application) for a distance sales contract or an off-premises contract. Goods that have been withdrawn must be returned in the packaging in which they were delivered. The packaging should be intact, clean, properly prepared and packaged. Otherwise, when returning the goods, the E-shop prefers that the same requirements are met or that every effort is made to comply with the specified packaging requirements.
29. The Customer shall have the right to withdraw from the contract of sale by notifying us by e-mail info@kiviboutique.com or in writing at Kosmonautų g. 12-5, Marijampolė, or by telephone +370 643 21464, within 14 (fourteen) days from the date of delivery of the goods.
30. If you wish to withdraw from the Sale and Purchase Agreement, you must notify your withdrawal in writing (free-form request) within the time limit set out in the Rules to the contact addresses set out in point 29 of the Rules. If the Customer does not receive confirmation within 3 working days, the Customer must contact the administration of the E-shop. If the Customer withdraws from the Contract, within 3 (three) working days, the Customer must agree with the E-shop by telephone or e-mail the method of returning the goods (all issues of pick-up, drop-off and other transport to the place indicated by the E-shop). In this case, the Customer is obliged to return the purchased product himself, in accordance with the requirements of Clauses 30 and 31 of the Terms and Conditions. In the event of withdrawal from the contract, the money paid for the product will be refunded within 3 (three) working days from the date of return.
31. The Customer shall not be entitled to withdraw from the contract of sale if the Goods have been damaged or if the appearance of the Goods has been substantially altered; changes in the appearance of the packaging which were necessary for the inspection of the Goods received shall not be considered to be a substantial alteration of the appearance of the Goods.
VII. FINAL PROVISIONS
32. The Online Shop reserves the right to suspend, amend, modify these Terms and Conditions and other documents related to the Terms and Conditions at its sole discretion. Amendments or changes to the Terms and Conditions shall come into force from the date of their publication, i.e. from the date on which they are posted on the e-shop system.
33. If the Customer does not agree with the new version of the Terms and Conditions, amendments, modifications, the Customer shall have the right to refuse them, provided that the right to use the e-shop services shall be lost.
34. If the Customer continues to use the services provided by the E-shop after the amendment of the Terms and Conditions, the Customer shall be deemed to have accepted the new version of the Terms and Conditions, amendments or additions.
35. Any disagreements regarding the application of these Rules shall be settled by negotiation. In the event of failure to reach an agreement within 30 (thirty) days, the disagreement shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
36. You can submit a request/complaint about a product purchased in the E-shop to the State Consumer Rights Protection Office (http://www.vvtat.lt).
37. These Rules shall be governed by the laws of the Republic of Lithuania.
